The terms cover the ayduke.com website, the AYDUKE panel and, where purchased, the plug-and-play publishing device. The processing of personal data is explained in the Privacy Policy and cookies in the Cookie Policy; these documents form an integral part of the terms.

Description of the service

AYDUKE is an automation tool that enables you to manage your social media accounts from a single panel. On the panel:

  • you set up your social media accounts once,
  • you create your posts and choose the accounts on which they will be published,
  • you set up the publishing calendar,
  • posts are published automatically when they fall due,
  • you monitor what has been published and what is queued from the panel.

The service transmits your posts to the relevant platforms with the authorisation you grant and on the calendar you set up. We do not produce the content itself; you decide what is published and when it is published.

We continue to develop the service: features may be added, changed or removed owing to technical/legal requirements. In the event of a change that materially affects the essential nature of the service, we will inform you in advance.

Account and authorisation

When creating a panel account, you must provide accurate and up-to-date information. You are responsible for keeping your account's sign-in details confidential and for the actions carried out through your account. If you notice any unauthorised access, notify us immediately.

When you connect your social media accounts to the panel, you grant AYDUKE authorisation to publish on your behalf. The limits of this authorisation are as follows:

  • Only you grant the authorisation; we do not connect accounts on our own initiative.
  • The automation publishes the posts you have scheduled; it takes no other action on your account.
  • You may withdraw the authorisation at any time from the panel or from the platform's own settings. Once the authorisation is withdrawn, scheduled posts cannot be published.
  • The accounts you connect must belong to you, or you must be authorised to act on behalf of those accounts.

Your obligations

When using the service:

  • You are responsible for ensuring that the content you publish is lawful and that you hold all necessary permissions (copyright, trade marks, personality rights, the consent of persons appearing in images, etc.).
  • You must comply with the own terms of use and publishing rules of the platforms you connect. These rules are set by the platforms and may change.
  • Compliance with legislation on advertising, sponsorship and commercial communications (including labelling obligations) is your responsibility.
  • The media files you upload to the panel must not exceed the media storage included in your plan.
  • You are responsible for ensuring that posts published through the service, the replies the AI assistant gives on your behalf and the fields you add to the booking form comply with the rules specific to your sector (for example, legislation and professional rules on promoting healthcare services). The assistant's replies are based on the information you enter in its knowledge base and the instructions you give.

If a claim, complaint or sanction is directed at us because your content is unlawful, we reserve the right to require you to make good any resulting loss.

Prohibited uses

You may not use the service to:

  • Generate unsolicited bulk messages (spam), misleading content, fake accounts or artificial engagement.
  • Publish hate speech, incitement to violence, harassment, discrimination or content that infringes personality rights.
  • Use another party's copyright, trade mark or trade secret without permission.
  • Connect accounts to the panel that you are not authorised to use.
  • Force the system other than for the purpose of testing its security, reverse engineer it, overload the service or attempt to block access to it.
  • Use the service in breach of the legislation of the country in which you are located or the country in which your target audience is located.

In the event of a breach of these rules, we have the right to suspend the account or terminate the contract (see suspension and termination).

Plans, fees and payment

The service is offered in three plans, on a monthly or yearly basis. The scope of the plans, the media storage and current prices are published in the Our plans section. Prices are not repeated in this document; the price that applies is the one published on the site at the time of payment.

  • Unless otherwise stated, prices do not include applicable taxes; taxes and similar charges are added in accordance with the legislation.
  • Payment is made by credit/debit card or by bank transfer (havale/EFT). Card payments are processed via Stripe and your card details never reach our servers; for bank transfers, your plan is activated once your payment has been credited to our account.
  • The subscription does not renew automatically. No automatic charge is made to your card at the end of the period; to continue, you initiate the renewal yourself from the panel. If a subscription is not renewed, access stops at the end of the period.
  • We may change prices. A change does not affect the current prepaid period; it will be notified to you before the renewal period.
  • If you renew before the period ends, your remaining time is not lost: the new period starts from the end date of your current period.

The statutory rights of withdrawal and rights in respect of defects of natural persons purchasing as consumers are not limited by this document.

Plug-and-play publishing device

The publishing device is not included in the plans; it is an optional hardware add-on and is charged in addition to the plan fee. You need to contact us for stock and delivery terms.

  • The device enables your posts to be published via your own device.
  • The running of the calendar depends on the device being switched on and connected to the internet. If the device is switched off, or if there is a power or internet outage, posts falling due at that time cannot be published.
  • Physically protecting the device and operating it in a suitable environment with your own power/internet connection is your responsibility.
  • Terms relating to warranty, shipping and delivery time are provided in writing at the time of ordering.

Platform dependency and service continuity

AYDUKE carries out publishing through the interfaces and rules of third-party social media platforms. This is a dependency inherent in the nature of the service, and we wish to state it clearly:

  • If a platform changes its rules, access conditions or technical interface, the relevant feature may temporarily not work or may fall outside the scope of the service.
  • We are not responsible for outages, delays, content removals, access restrictions or account suspensions originating from the platforms.
  • The service may be briefly unavailable owing to maintenance, updates and technical necessities. We endeavour to announce planned maintenance reasonably in advance.
  • Timely publishing depends on a correctly set-up calendar and (if you use the device) on the device being in working order.

No particular availability rate (SLA) is guaranteed; if a separate written service level agreement is concluded, that agreement applies.

Intellectual property

The rights in the AYDUKE name, logo, interface, software and site content belong to DURU AKADEMI LTD or its licensors. The right to use the service is a non-transferable and non-exclusive right of use granted for use in accordance with these terms; it does not include the right to copy, reproduce or rent the software or to create derivative works.

Your content remains yours. The rights in the text, images and videos you upload to the panel belong to you. The permission you give us is limited to what is necessary to provide the service: storing and processing the content and transmitting it to the relevant platforms on your instructions.

The names and logos of social media platforms are registered trade marks of the respective companies; they are used on the site for identification purposes only.

Your customers’ data (data processing)

Through the chat window, social media messages and the booking system, personal data of your customers (name, contact details, appointment time, message content and technical records) are processed. For this data you are the controller; DURU AKADEMI LTD acts only as a processor, on your instructions and solely to provide the service. This section constitutes the data processing agreement between us under Article 12 of Turkish Law No. 6698 (KVKK) and Article 28 GDPR.

  • Instructions and purpose: We process the data only to provide the service and apply your settings in the panel; we do not use it for our own purposes, sell it or use it for advertising.
  • Confidentiality and security: Only persons who need access for their duties and who are bound by confidentiality can access the data; we apply the technical and organisational measures described in the Privacy Policy.
  • Sub-processors: We use service providers for hosting, email and SMS delivery and AI reply generation (currently OpenAI, USA). We enter into contracts with data protection obligations with them; we share the current list on request and give advance notice of significant changes.
  • International transfers: Data may be processed outside Turkey and the European Economic Area; transfers rely on the safeguards required by applicable law (such as standard contractual clauses).
  • Data subject requests: We provide viewing and deletion tools in the panel so you can respond to your customers' access, rectification and erasure requests; requests that reach us directly are forwarded to you.
  • Breach notification: If we become aware of a security breach affecting the data, we notify you without undue delay and provide the information you need to meet your obligations.
  • Deletion: You can delete records from the panel at any time. When your account is closed, customer data other than what must be retained by law is deleted within a reasonable period.
  • Special category data: The service is not designed to collect special category data such as health information; the booking system stores only the name, contact details and appointment time. Healthcare businesses should not add fields to the booking form asking for complaints, test results or treatment information. If you need such information, obtaining explicit consent and providing the safeguards required by law is your responsibility.
  • Information: On reasonable request we provide information demonstrating our compliance with these terms.

If you need a separately signed data processing agreement, write to hello@ayduke.com.

Limitation of liability

We endeavour to provide the service with care; however, we do not guarantee that it will operate without interruption or error, or that it will produce any particular commercial result (reach, followers, sales).

To the extent permitted by applicable law, we are not liable for indirect loss, loss of profit, loss of data, loss of reputation or loss originating from third-party platforms. In any event, our total liability is limited to the amount you paid us for the service in the twelve (12) months preceding the event giving rise to the claim.

These limitations do not apply in cases of wilful misconduct, gross negligence or liability that cannot be limited under the legislation. The statutory rights of consumers are not affected.

Suspension and termination

You may stop using the service at any time and request that your account be closed. Refunds of fees for a paid period are subject to the payment terms between us, without prejudice to any statutory rights you may have.

We may suspend the account or terminate the contract in the following cases:

  • A breach of these terms, in particular of the prohibited uses section.
  • Failure to make payment despite notice.
  • Use that threatens the security of the service or other users.
  • A legal requirement or a decision of a competent authority.

Insofar as the nature of the situation permits, we will inform you before suspension and give you time to remedy it. After termination, your data other than that subject to a legal retention obligation is deleted; if you request it, we will enable you to obtain a copy of your data within a reasonable period.

Governing law and changes

These terms are governed by the laws of England and Wales and the courts of London (England) have jurisdiction over disputes. The ability of natural persons acting as consumers to benefit from the protection afforded by the consumer legislation of the country in which they are located and from the right to apply to the competent consumer bodies is not affected.

When we make changes to the terms, the current text is published on this page and the date at the top of the page is updated. We will also notify material changes separately to users with whom we have a service relationship. Your continued use of the service after a change means that you accept the new terms.

If any provision of the terms is held to be invalid, the remaining provisions remain in effect.
